TERMS OF SALE

1. – DEFINITIONS

1.1 For the purposes of this contract shall apply:

– Lorenzo Mascelli ditta individuale (hereinafter referred to as, “7Dline by Googold” or “Seller”) the person engaged in marketing of jewelry, precious stones, the provision of related services such as support, customization and repair (hereafter referred to as the “Product” or “goods”) through the site 7dline.com, managed by the same;
– The “Buyer” or “Customer” means the purchaser under this contract;
– The “Consumer” or “End user” means the person who undertakes any activity not related to selling or business
– Proposal for sale: place your order electronically by the Customer in which you specify the types, characteristics of the product that you want to buy, the sale price and shipping costs, charged to the customer.

1.2 Identification of the Seller: The products covered by this contract and relative terms and conditions are offered for sale by Lorenzo Mascelli, sole trader, whose registered office is in Via Fieschi, 2/18 – 16121 Genova (GE) ITALY, VAT no. 01670360997, and trading as “7Dline”.

2. – CONCLUSION OF THE CONTRACT

2.1 The Proposal for a sale is “not subject to generation”. 3. – PURCHASE

4. – PAYMENT

4.1 Payment of the price of products and their shipping costs can be made by cash, credit card, bank transfer prepayment Paypal.

4.3 In cases of purchase of goods with payment methods Credit Card, together with the conclusion of the transaction online, the bank of reference shall authorize only the commitment for a purchase made.

4.5 In case of purchase through the PayPal payment method at the end of the customer is directed to the login page of PayPal.

In case of cancellation, either by customer or in the case of non-acceptance of 7Dline by Googold, the amount will be refunded on the customer’s PayPal account.

5. – DELIVERY

5.1 The delivery times of ordered products are given in the detail of the product and are purely indicative, and the same may be changed for reasons of force majeure (strikes several of the carriers, etc..) 5.3 7Dline by Googold communicate to the customer, by sending an e-mail to it, indicating the date on which the package was delivered to the courier and the tracking-number “on the package that will allow the customer to verify the course of the expedition.

5.4 The obligation of delivery of the product in the hands 7Dline by Googold it regularly fulfilled when the goods ordered are delivered to the courier. Therefore, any delay and / or errors or similar events in the delivery of the parcel, should be attributed solely to the company that manages the shipment. In such circumstances, the Customer undertakes not to make any claim for damages against 7Dline by Googold.

6. – DELIVERY OF GOODS AND INSURANCE

6.1 The Goods ordered will be delivered by courier to the customer and / or shippers of confidence.

6.2 Delivery will be made by appointment. The courier will send an e-mail directly to Customer, stating the day of delivery. In the absence of the Customer, the courier will leave a notice, asking to be contacted at a toll free number to make the appointment. In case of further absence, any charge levied by courier will be charged to the customer. If you do not make more available, the goods will be made to 7Dline by Googold, resulting in cancellation of the order and nothing is due to Customer.

Transport costs will be charged to the customer.

6.3 Delivery will be made within 3 working days from the date of the telephone.

6.4 All jewelry 7Dline by Googold are covered by free insurance while shipping.

7. – COMPLAINTS

7.1 It is the responsibility of the Buyer to verify on receipt of delivery that the number of parcels delivered is as stated on the associated manifest or invoice, that the packaging is in good condition, undamaged, not water damaged or otherwise interfered with.
The buyer shall also examine the package contents to identify if there are any defects or damages to the delivered goods.

7.2 Any damage or exterior signs must be immediately notified to the courier who makes the delivery, the words “SUBJECT TO INSPECTION PRODUCT” on the accompanying document and confirmed within 7 days by registered letter with return receipt to the courier, whose address is explained on the accompanying document.

7.3 In case of package damaged write “subject to withdrawal because the package is damaged.” Once signed the document of the courier, the customer can not invoke any dispute about the external characteristics of the delivered.

7.4 Any hidden defects (eg, theft, missing, damaged by the transport) must be reported in writing by registered letter with return receipt to the courier, the address of which is explained on the accompanying document, within 8 working days from delivery.

8. – GUARANTEE

8.1 All products sold by 7Dline by Googold are accompanied by a guarantee of workmanship and execution of the Manufacturer and the guarantee for defects in production. To qualify for warranty service, the Customer shall keep the invoice (or DDT), which together receive the goods purchased. 8.2 The manufacturer’s warranty is provided in the manner described in the documentation inside the packaging of the product.

8.3 The warranty for any defects in manufacturing or construction (loss of stones, etc..) Pursuant to Legislative Decree No 206/05 applies to the product with a lack of conformity, provided that the same is used correctly, respecting its intended use. In case of lack of conformity, 7Dline by Googold shall, without charge to the customer, to restore conformity of the product by repair / replacement or reduction of price, until the termination of the contract. If, after intervention by an Authorized Service Center, should not be a lack of conformity in accordance with art. 130, d. Lgs n.206/05, the Customer will be charged for any costs of verification and recovery, and transportation costs if supported by 7Dline.

8.4 In the event that, for whatever reason 7Dline by Googold, can not replace a product under warranty (restored or replaced), may proceed with the consent of the Customer, the replacement by another product of equal value or characteristics and, finally to issue a voucher for the same amount on another spendibile product valid for 6 months from the date of issue.

8.5 Repairs or replacements will be effected within a reasonable timeframe following the receipt of the request and depending on the product, with the aim of not inconveniencing the Buyer. No damage can be obtained from 7Dline by Googold for any delays in operating repair or replacement of products under warranty.

8.6 The Consumer may report any defect of conformity which becomes apparent within a period of 2 years of delivery of the goods. The report must be effected within two months of the defect being discovered. For those who are not the Consumer, regulations and laws in force at the time of the report are applicable.

9. – RIGHT OF WITHDRAW AND REFUND PROCESS

9.1 Withdrawal process: The right to withdraw must be exercised by the Buyer within the first inclusive 30 day period from the receipt of goods (14 working days in the case of certified diamonds)
The request to withdrawal or cancellation, as long as issued within the times indicated above, can be sent via e-mail to 7dline@gmail.com, on the condition that this is followed by confirmation of the request via recorded delivery with proof of receipt within 48 (forty eight) hours of aforementioned email.
In order to speed up the process of returning the purchased goods, the Customer may in any event, give forward notice of intent to withdraw to the following e-mail address: 7dline@gmail.com

9.2 Returns process: The returned goods must be carefully resealed in their original packaging and shipped in a padded envelope large enough for the package, sealed with either personalised parcel tape or alternatively with standard parcel tape, but signed across the seal as a further security measure for unique identification.
The envelope must contain the name and address of both the destination and the sender (crossed), which will be used for the returns processing.
The envelope or any accompanying documentation must absolutely not contain any words such as, jewel, gem, ring, gold, diamond or any other such words that may indicate the nature of the contents.

9.3 With reference to returns of high value goods the Customer must get in touch with 7Dline by Googold to arrange a trusted courier who will collect the goods to be returned. The Customer is responsible for insurance and shipping costs.7Dline by Googold cannot be held responsible for any loss, theft or damage incurred on returned goods.

9.4 The Buyer shall be entitled to reimbursement of the cost price of the goods, nett of shipping costs, for which they are responsible, only once the Seller has confirmed that the goods are in perfect condition as sold.

9.5 The Seller is liable for refunding the whole amount of the purchase, where the right to withdrawal or cancellation has been exercised in full compliance with the prescribed process and the rule of law; 7Dline by Googold reserves the right to refuse a refund in the event that the goods have suffered a reduction in value due to prolonged wear, or are damaged or altered in any way.
Full refunds are only due under the following conditions:

The goods must not have been worn for any prolonged period or present any signs of wear and tear, scuffs, scratches, or any marks that would prevent the goods from being sold as new.
Any labels or tickets present on original delivery must not have been removed and must be still attached
The goods must be returned in their original packaging
Diamond certificates must be returned sealed in their original blister pack.

9.6 7Dline by Googold will refund amounts paid by the Customer save for any shipping expenses incurred, in the same way that was used for payment, within 15 working days of receipt of the returned goods. Refunds other than to the original payment method will be considered on a case by case basis.

9.7 Returns costs. Returned goods are shipped at Customer’s risk and expense. It is recommended that 7Dline by Googold is contacted in order to select the most appropriate shipping method. Expenses incurred in the returns process may be reimbursed but solely in the event of a verifiable error by 7Dline by Googold.

9.8 Insurance and shipping for returned goods are the Customer’s responsibility. If the Customer does not insure the goods in transit, they will be solely responsible and liable in the event of loss or theft.

9.9 Exclusions. The right to withdraw or cancel does not apply where the goods have been custom made or personalised in any way.

10. – DESCRIPTIONS AND IMAGES

10.1 All descriptions of products visible in the online catalog are as accurate and up to date.

10.2 Images of each product is accurate as possible, however the same may not differ so significantly to the product purchased, for example, in color, in form and size. For better exposure of the products offered some images are magnified compared to the original and, therefore, not to scale 1:1.
All weights and measurements are approximate.

11. – PACKAGES

11.1 All jewelry purchases are sent in gift box at no additional cost. The packages may vary in shape and color than those published in this site which are therefore considered to be purely illustrative.

11.2 The diamond certificates are sent in sealed blister pack provided by the manufacturer in turn inserted in the envelope containing the original certificate.

11.3 Each consignment is packaged padded envelope with high resistance and sealed with adhesive tape and personal guarantee.

12. – COMMUNICATIONS

All communication or query, unless agreed otherwise, must be via e-mail, or where indicated, by recorded delivery. Any time sensitive communication should be communicated by telegram or telefax, to the Parties’ home address, or to the notified address.

13. – PRIVACY

13.1 The personal information requested during the forwarding of collected and processed by 7Dline on media in order to meet the obligations arising from the contract concluded with the customer and will not under any circumstances and no title passed to a third party, unless the Customer consent themselves. 7Dline by Googold provides its customers comply with the law on the processing of personal data, governed by the privacy code referred to in Legislative Decree no. 196/03. 13.3 At the Customer, at any time, have the right to withdraw consent to the processing of personal data by means of written notification to be sent to the registered office of Googold by Lorenzo Mascelli

13.4 The client, who claims to have received information in accordance with art. 13 and the rights belonging to the same, according to art. 7 of Legislative Decree no. 196/2003, has the right to access their data in the manner specified therein. Marketing communications will be sent only with the explicit consent of the customer authorization issued jointly to the processing and sending the registration form online.

14. – PRICE, INVOICING VAT

14.1 Delivery charges are normally included in the price, unless otherwise indicated.
The value added tax at the rate in force in Italy (VAT) is charged for all shipments with final destination within the EU countries.
VAT is added to the total of the sale in an automatic way in order to complete phase depending on destination requested by the customer.

14.2 For each consignment 7Dline by Googold shall issue regular invoice.
Only a limited shipments to residents in Italian territory instead of the invoice will be issued a separate delivery to accompany the shipment. The invoice shall be authentic as proof of ownership and also for the guarantee of law and any exercise of the right of withdrawal.

14.3 Prices published in the website for each product are updated and accurate. However, if after all ‘order were recorded from 7Dline by Googold of material errors and / or obvious in the price, the seller reserves the right to inform the customer the correct price and updated without entailing the occurrence of no obligation on either party.

15. – APPLICABLE LAW AND JURISDICTION

15.1 This Contract of sale between the Client and Googold by Lorenzo Mascelli is governed by Italian law.

15.2 Any disputes related to this Customer contract will be dealt with by the relevant territorial jurisdiction which is defined by the Customer’s place of residence or domicile if residing in the territory of the State.
